The website www.uvbackups.com is owned and operated by UV Backups, LLC., a Michigan corporation ("UV Backups"). UV Backups respects your individual privacy. It is our goal to maintain a great relationship with our customers. As part of that, we will only utilize your personal information to better the quality of service you receive. You have our promise that UV Backups will not electronically process your personal information in any way that is incompatible with this Privacy Policy.

Applicability of Privacy Policy

This Privacy Policy is intended to apply to information collected from www.uvbackups.com.

In cases of a paid subscription, we also collect financial information, such as account or credit card numbers. Information collected from the subscription form is used to send orders, billing materials, and information about UV Backups. This information is also used to contact you when necessary in connection with our services. Financial information that is collected is used strictly for internal billing purposes only. Some of the information UV Backups receives about you or your visit to www.uvbackups.com may be used for our internal research and to help us to improve the site and the services UV Backups offers to its customers. We use other third parties to provide enhanced notification services and member credit card processing on our site. UV Backups utilizes "cookies" to track and store information about www.uvbackups.com users. "Cookies" are alphanumeric identifiers in the form of text files that are inserted and stored on your hard drive. We use them to validate user sessions for your own account security.

Choice/Opt-out (Free / Trial Accounts)

UV Backups may send promotional communications to users who are using some free version of our monitoring service which may include monitoring results to date and additional information regarding UV Uptime's products and services.

In addition to the promotional communications for free services, users also receive an order confirmation e-mail along with a security verification e-mail immediately following registration.

Users are not given the choice to opt-out of receiving the communications described above since they are requirements of registering for free services.

Choice/Opt-out (Other)

Our users are given the opportunity to opt-out of having their information used for purposes not directly related to our site at the point where we ask for information. For example, our order form has an opt-out mechanism so users who buy a service from us, but don't want any marketing material such as information about upgrades, discounts or special promotions, can keep their e-mail address off of our lists. For any non-service related communications or information uses, our opt-out mechanism defaults to the opted-in status until users explicitly opt-out for the first time.

Users who no longer wish to receive our newsletter and promotional communications may opt-out of receiving these communications by e-mailing us at optouts (at) UVUptime.com or by contacting us by telephone or postal mail at the contact listed below.

Access to Personally Identifiable Information

A user may access their personally identifiable information through a secure login provided on our web site.

If your personally identifiable information changes, you may correct or update it by making the change directly through the Customer Management Area. Customer Testimonials

We post customer testimonials on our web site which may contain personally identifiable information such as the customer's name. We do obtain the customer's consent, prior to posting the testimonial, to include any personally identifiable information along with the testimonial.

Governing Law and Jurisdiction

This Privacy Policy is to governed and construed in accordance with the internal laws of the State of Michigan, without regard for principles of conflicts of laws.

Any civil action, claim, dispute or proceeding arising out of or relating to this Privacy Policy shall be referred to final and binding arbitration, before a single arbitrator, under the commercial arbitration rules of the American Arbitration Association in Kent County, Michigan.

The arbitrator shall be selected by the parties, and if the parties are unable to reach agreement on selection of the arbitrator within thirty (30) days after the notice of arbitration is served, then the arbitrator shall be selected by the American Arbitration Association.

Judgment upon any award rendered by the arbitrator shall be final, binding and conclusive upon the parties and their respective administrators, executors, legal representatives, successors and assigns, and may be entered in any court of competent jurisdiction. Notwithstanding the previous sentence, in no event shall any party be entitled to punitive damages and all parties hereby waive their rights to any punitive, special, indirect or consequential damages, including, but not limited to, damages for any loss of profit, revenue or business. The total liability of customer or UV Backups for damages arising out of or in connection with this agreement is limited to an amount equal to the total charges payable by Customer during the month any potential liability may have arisen.

If any portion of this Privacy Policy is deemed unlawful, void or unenforceable by any arbitrator or court of competent jurisdiction, this Privacy Policy as a whole shall not be deemed unlawful, void or unenforceable, but only that portion of this Privacy Policy that is unlawful, void or unenforceable shall be stricken from this Privacy Policy.
